To support changes made on 25 May in European data law, known as GDPR, these Terms & Conditions have been updated. We provide clear information on how we handle, store and protect your personal data.


Our Contract


Please find set out below the terms and conditions upon which Special Occasion Cars, Carts & Castles 4 U (known from here on as ‘us’/our’/‘we‘) will provide our services to our client (known from here on as ‘you’/‘your’). Please read them carefully and make sure you understand them. Please note that by using our service, you agree to be bound by these Terms. Please read these carefully and sign at the bottom to signify that you acknowledge and accept these Terms and Conditions.


If there is anything you do not understand, please do not hesitate to contact us and we will provide clarification.


Our Services


We provide an inflatable Bouncy Castle. Booking of an event will only be confirmed once the relevant deposit is received. On making a booking through us you will enter into a contract for the hire of the inflatable described in your confirmation which will be emailed to you.


We will require information from you to enable us to arrange the hire. It is important the information is true and accurate. We would ask that written confirmation is emailed to us confirming that the booking details are correct. We do not accept any liability if your booking later proves to be incorrect. We will confirm any changes in writing to avoid any confusion between you and us.  


Upon receipt of your booking request we will contact you to discuss availability. If we are able to provide our services we will obtain full information of your requirements and provide a booking confirmation. If we are unable to provide our services we will inform you of this in writing.  


Your responsibilities


  • To notify us of any changes in your address or contact details following the acceptance of your booking.
     
  • To be aware of the sizes of the equipment and clearances required before delivery (inadequate space).
     
  • To ensure that all the reasonable steps are taken to avoid injury or cause damage to the equipment.

Please ensure that the following safety instructions are followed:


  1. No adult should use any equipment that is supplied solely for children's use. These units are intended for use by persons below the age of 12 years (Please ensure no persons over this age uses the equipment.
  2. A responsible adult (over 18 years of age) must supervise the equipment and children at all times. No person under the influence of drink or drugs should supervise or use the equipment. Also a responsible adult (over 18 years of age) must be present at the delivery address during delivery and collection.
  3. Please have 2 forms of ID with at least one photo and your home address. For example your driving license, your passport, a recent utility bill or bank statement. (This is essential for hires in venues/halls). 
  4. Please have full payment in cash ready to pay the delivery team (unless you have paid by cheque, bank transfer or other method in advance). Sorry we do not accept cheques or card payments to the driver.
  5. Please note: if you don't have ID & payment on delivery, our delivery team may cancel your order.
  6. Always ensure the equipment is not overcrowded, and limit numbers according to the age and size of people using it. Always avoid a mix of large and small children at the same time.
  7. Do not allow anyone to bounce on the front step as children could easily bounce off the inflatable and get hurt. The step is there to assist users to get on and off! Always enter and exit the inflatable from the front of the step and not the sides. Any safety mats supplied are to be kept in position and users must enter and exit the bouncy castle via the matted area (full adult supervision required!).
  8. Ensure that no person with a history of heart, neck or back problems, high blood pressure, joint weakness or any person with a history of known medical disabilities are allowed to use the equipment. Also any person who feels unwell should be removed immediately.
  9. Climbing, hanging or sitting on the side walls is dangerous and must not be allowed.
  10. Children should not be pushing, colliding, fighting, attempting somersaults, wrestling, running or behaving in a manner likely to cause injury, damage or distress to others or the equipment.
  11. Do not allow anyone to be on the inflatable during inflation or deflation as this could damage both the equipment and injure the user.
  12. Where applicable ensure a safety zone of 6 feet (2 metres - subject to initial safety survey) around the equipment is kept clear at all times and use anchors provided. Occasionally check that the inflatable equipment is securely anchored/pegged down.
  13. All shoes, glasses, jewellery and badges must be removed before using the equipment.
  14. No face paints, party poppers, coloured streamers, silly string, food, drinks, sweets, chewing gum, pens, water (hose-pipes, water pistols etc), soapy water (to create foam!), Pets, toys, barbecues, smoking, shoes or sharp objects are to be allowed on or near the equipment. This will avoid both choking hazards and potential soiling of the equipment. Any excessive soiling will mean the deposit will not be refunded.
  15. Do not glue/stick/attach or hang any notices or signs to the bouncy castle and equipment as this can cause injury to the users and this normally also leaves a sticky residue on the equipment which is very difficult to remove. Again, this will result in the deposit being retained by ourselves.
  16. In the event of an accident occurring, please notify us immediately by telephone on the emergency contact number we provide on the day of your event.  Full details must be recorded in writing, including: name and address of injured party, date, time and place of incident, circumstances of accident, responsible supervising adult. A copy of the report must be handed to the driver on collection of the equipment or sent to Special Occasion Cars, Carts & Castles 4 U within 7 days.
  17. Once the inflatable has been set up/erected by our by our delivery team, do not move or reposition the inflatable without our permission. Failure to comply may result in injury to users, any insurance invalidated and also damage to our equipment. Any damage caused by the hirer moving or repositioning the inflatable without our permission shall deem the hirer liable for full repair or replacement costs in addition to any loss of business as a result of such loss or damage as per hire contract.
  18. Please leave the inflatables running at all times, even during light rain. However, it is strongly recommended that the inflatable should not be used in high winds or wet conditions. Please only switch off the inflatable during extremely high winds and/or torrential rain. After rain showers, any wetness including bubbling (which is normal) can be dried with the aid of a towel. We reserve the right to cancel and/or collect the equipment at any time if severe weather warning comes into force.
  19. In the event that the blower stops working, ensure all users exit the inflatable immediately. Make sure the blower tube has not come loose, the deflation zip is still closed and that nothing is obstructing the blower. Failing all this, please contact us for possible further assistance.
  20. Always use the RCD plug provided (where applicable). Only electrical equipment supplied by us, as all electrical equipment is fully tested to the appropriate Health and Safety Guidelines by a qualified electrician and fitted with British Standard approved connections. These connections are splash-proof (except RCD's) and can be left out in wet weather although do not allow them to become submerged in water.
  21. Do not allow any person to interfere, adjust or repair any electrical item, even if qualified to do so. Failure to do so may result in additional cost for replacement or repair of damage parts.
  22. Any damage to the equipment caused by misuse, neglect, loss or failure to follow these conditions, shall deem the Hirer liable for full repair or replacement costs in addition to any court costs or any loss of business as a result of such loss or damage as per hire contract.
  23. Special Occasion Cars, Carts & Castles 4 U cannot be held liable for any damage to property (indoors or outdoors) whilst delivering or collecting equipment. It is the Hirer’s responsibility to ensure that our delivery team has adequate access and clearances also to inform us of any known underground services present when securing the equipment to the ground using ground stakes (anchors).
  24. Any extension cables which cannot be safely rooted out of the way of pedestrian traffic will need to be taped down and untaped at the end of the hire by the Hirer or covered with suitable shielding/matting or equivalent.
  25. It is the Hirer’s responsibility to arrange adequate supervision of the children or vulnerable adults during setting up and packing away of the inflatable and equipment. Do not allowed the children or vulnerable adults to touch the equipment during setting up and packing away. Special Occasion Cars, Carts & Castles 4 U cannot be held responsible for children or vulnerable adults getting hurt on our equipment during setting up and packing away.

Payment


We will not request payment until we accept your provisional booking. We will confirm arrangements in writing and ask that a £50 deposit is payable to secure your date. Payment can be made preferably by BACS, details of which we will provide, or by cash. A receipt confirmation will be issued.


If the remaining balance is not made by the due date we reserve our right to cancel the booking and will advise of this to you in writing. This date will be advised in the booking confirmation.


Damage deposit


For events in a domestic environment (private garden etc) we will also require a £50 damage deposit. A deposit of £100 is required for hires in a communal area or venue hire where the general public have access to our equipment. This is to encourage supervision of our equipment due to potential malicious damage or theft of our equipment by third parties.


Assuming there is no damage to our property or missing items, the deposit will be returned at the end of your event.

On the day of your event


We will require a minimum of 25 minutes before your event and 25 minutes following your event for both set-up and dismantling of the equipment. If there are any delays due to gaining access; inadequate parking distances of our vehicle outside the property or venue; excessive distances to set-up point from our vehicle; moving items like garden furniture, trampolines etc; inadequate space/clearances; cutting overhanging branches or mowing the grass etc, then we reserve the right to cancel your booking. If this situation arises, the deposit will be forfeit.


Important note


The delivery team will be the same team who will collect the bouncy castle and equipment. Due to potential theft, we do not send anyone to collect the equipment on our behalf! (You will be fully liable (negligence) for new replacements and costs if the equipment is collected by anyone else except Special Occasion Cars, Carts & Castles 4 U!)


The inflatable unit must be inflated upon our return. We will then examine (with you) the equipment to ensure there is no damage or missing equipment. If we are satisfied with its condition, your deposit will be returned to you.


Disclaimer


We reserve the right to take photographic images of the Castle at your event and use them for marketing purposes on our website. For data protection purposes, no photos will be taken of any of your guests.


We have DBS clearance as well as full liability insurance. This information will be available for viewing at your event if necessary.


Please note that all persons using the equipment do so at their own risk. The hirer of such equipment will be responsible/liable for any damage or injury occurring from or as a result of misuse, neglect or reckless use of such equipment hired. The guidelines above are for the safety of all people using this equipment, and it is the sole responsibility of the Hirer to ensure they are fully adhered to at all times.


Special Occasion Cars, Carts & Castles 4 U cannot accept any responsibility for any injuries sustained by anyone using the equipment hired. It is strongly recommended that the Hirer (you the customer) has adequate public liability insurance.


Cancellation


If you decide to cancel within 7 days of the hire date then only the deposit will be lost. Any advance payments made to us will be refunded if the cancellation is made within this time frame.


Events outside our Control


We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event outside our Control. 


An Event outside our Control means any act or event beyond our reasonable control including traffic, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks, congestion, accident or criminal activity.


If such an event takes place that affects the performance of our obligations we will contact you as soon as reasonably possible. We will do everything in our power to ensure we meet our contracted services.


However, for outside events if weather conditions (ie high winds, storms or torrential rain) are such that we are prevented from setting up our equipment, we will refund in full.


How we may use your personal information


We will use the personal information you provide to us to:


  • provide the services
     
  • process your payment for such services. 

We will not give your personal data to any other third party. Whenever you have given us your consent to use your personal data, you have the right to change your mind at any time and withdraw that consent. However we will still be required to hold your information under contractual obligations if you have used our services and we have received payment.


How your data is stored?


We know how much data security matters to all our customers. With this in mind we will treat your data with the utmost care and take all appropriate steps to protect it.


Access to your personal data is password protected when held in cloud-based software or secured in a locked cabinet.


The systems used for processing and storing your data are password protected and encrypted (please see their own privacy statements by using the links below).

How long will we keep your personal data?


Whenever we collect or process your personal data, we’ll only keep it for as long as is necessary for the purpose for which it was collected.


When you place an order for our services, we’ll keep the personal data you give us for five years so we can comply with our legal and contractual obligations. At the end of that period, your data will either be deleted completely or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning.


Other important terms


This contract is between you and us. No other person shall have any rights to enforce any of its terms.  

We may vary these Terms from time to time to make changes to how we accept payment from you, to reflect changes in relevant laws and regulatory requirements or to improve the manner in which we provide our Services.

I have read, understood and agree to abide by these Terms and Conditions. (I am aware that whilst in my care I am fully responsible for the inflatable and equipment and will pay for any loss or damages that may occur).
